Dist. of Nacogdoches, 22 Nov. 1836
To Honorable Alcalde of the aforesid Dist.
The Petition Collin Aldrich Expectfully shewith that Ran-
dolph Yarbury of this Dist. is now seized and possessed of cer-
tain dark roan horse 2 years old passed, branded with the let-
ter C and about 14 hands high, which horse your Petitioner
owns to be his own private property foaled and raised his own
and that he has never sold, travelled or otherwise legally
disposed himself of the right of property of said horse.  Where-
fore your Petitioner prays that process may issue from your
honors Court forthwith and justice be executed in his premises.

    Personally appeared before me Collin Aldrich who being
duly sworn deposeth that the facts stated in the foregiving Pe-
tition are literally true to the best of his knowledge & be-

                        To William Harness
                        Sub Sherriff
                        Greeting:
    You are hereby Commanded to summon Randolph Yarburty to
appear at this office on Thursday the 15th day of Decr. next
and answer to a plea of right of property in and to a certain
Horse claimed by Collin Aldrich, You are also required to
take possession of said Horse, and produce it at this office
on the day of trial, hereof fail not.
