Belcher Road Cemetery [ aka James Smith Burying Ground ]

This cemetery is located on the north side of Belcher Road in the Town of Lee, between West Branch and Point Rock. The James Smith farm is across the road from the cemetery. The oldest stone dates to 1848 and the most current is 1956. There are no known records for this cemetery. The grounds are maintained by the Town of Lee.

Deed Book 305 pg. 158

This Indenture made this thirty-first day of March in the year of our Lord one thousand eight-hundred and seventy, between James Smith and Lucy Smith, his wife, of the Town of Lee, Oneida County and State of New York of the first part, and Francis Winchell, John Butte and John H. Smith, Trustees of the Burying Ground known as the James Smith Burying Ground and their successors in office of the second part, witnesseth that the said partys of the first part in consideration of the sum of Twenty-One ($21.00) to them duly paid has sold and by these presents does grant and convey to the said partys of the second part, and their successors in office, all that tract or parcel of land situate in the Town of Lee, Oneida County and State of New York, known as the James Smith Burying Ground as now occupied and fenced, on the said James Smith Farm.

With the appurtenances and all the estate title and interest therein of the said party of the first parties, and the said James Smith and Lucy, his wife, does hereby covenant and agree to and with the said party of the second part and thier succesors in office that the premises thus conveyed in the quiet and peaceable possession of the said party of the second parties, their heirs and assigns, they will forever warrant and defend against any person whomsoever lawfully claiming the same on any part thereof.
