General Notes: Name: James Vass Brooke
born at Falmouth, Virginia, October 10, 1824, son of William Brooke, exporting merchant, and Jeannie Morrison, his wife, half-sister of James Vass, of Fredericksburg. He studied law under Judge R. L. C. Moncure, settled in Warrenton, and began law practice at the early age of nineteen years. He was an ardent Whig. He served as commonwealth attorney, and state secretary of the American party. He was elected to the convention of 1861, and signed the ordinance of secession. In 1862 he organized and took to the field, Brooke's battery, which was attached to Jackson's corps. During the valley campaign, his ankle was broken by the kick of an artillery horse, but he returned on crutches, and took part in the battle of Fredericksburg. His disability forbade further military service, and in 1863 he entered the house of delegates, in which he served until the fall of Richmond. After the war he was a law partner of Hon. R. Taylor Scott, in Warrenton, and his practice covered a period of fifty-five years. He canvassed actively for every Democratic presidential nominee from 1868 to 1896, when he supported Palmer and Buckner. He served several times in the house of delegates and senate, and in the latter body, in 1877, labored arduously for the "Brooke bill," providing for an amicable settlement of the state debt. In the next session he was chairman of the judiciary committee, and took a leading part in the revision of the code of Virginia. He served in all important offices, and was largely instrumental in modernizing the pavements, lighting and water supply of Warrenton. He was for forty-five years an elder of the Presbyterian church, and many times a delegate to the general assembly; for two years acceptably filled the pulpit in the absence of the pastor; and was for twenty-five years superintendent of the Sunday school. He died October 9, 1898.
In politics he was a follower of Henry Clay.

obituary of Mrs. Francis E. Brooke
Mrs. Brooke, the youngest child of Col. John Ambler, of Richmond, was born in that city, May 18, 1815. On the 25th of November, 1837, she became the wife of the late Francis E. Brooke, Esq. (he died two weeks before his wife), and after spending fifteen years partly at Millfarm, Louisa County, Va., and partly in Richmond, removed in 1852 to St. Julien.

Died.-At St. Julien, near Fredericksburg, May 3, 1874, Mrs. Francis E.Brooke, in the 59th year of her age.
Her last illness was long and painful, but no murmur fell from her lips. Her husband, over whom she had so long watched with an affection which neither sickness nor suffering could abate, was taken from her on the 16th of May. And now she seemed to think only of him and her Savior. Her prayers went up continually to Him, that he would bless her children and take her to be with Him and with her husband. Amid sufferings the most cruel and protracted she looked continually to Jesus. She trusted only in Him; and He whose "strength is made perfect in weakness" upheld her with His truth, and made her to realize, even in the Valley and the Shadow of Death, that underneath her were the everlasting arms. 3

General Notes: Essex County, Virginia, America(killed in action), Gettysburg, Pennsylvania.
Richard Brooke Garnett, twin brother of William Henry Garnett, was born on November 21, 1817. His father was Colonel William Henry Garnett [1786-1866] of the "Rose Hill" plantation, Virginia, and his mother was Anna Maria Brooke [1787-1854]. Depending on several different accounts, the Garnett brothers were born at one of the family's three plantations: Rose Hill, Champlain ["Font Hill"], or Mount Pleasant. There were also six girls in this family, each of whom married influential professors, engineers, or military men. One sister married the man who would later become the chief engineer to General Stonewall Jackson.

After receiving excellent early education in Essex County and also in Norfolk, Richard Brooke Garnett entered the West Point Military Academy in 1836. He graduated from the United States Military Academy in the West Point class of 1841, ranked in the 29th position in the class [two spots behind his cousin, Robert Selden Garnett]. He was commissioned a second lieutenant in the 6th US Infantry in 1841. He began his service in the field during the Second Seminole War in Florida, 1841-2. After he saw minimal action, he was ordered west and served at various locales in his commissioned rank at Jefferson Barracks [Missouri], Fort Towson [in the Indian Territory], and at Fort Smith [Arkansas.

He was aide-de-camp to his uncle, Brvt. Brigadier General George Mercer Brooke, at New Orleans, and at San Antonio, Texas, 1845-51. He was promoted first lieutenant on February 16, 1847. He was on frontier duty at Fort Laramie, Dakota, 1852-54; on recruiting service 1854-5 and was advanced to captain in the 6th US Infantry on May 9, 1855. The rank of Captain was the highest staff position that he would achieve while serving in the Federal army. He continued to serve with the "Old Army" at Fort Pierre where he assisted in quelling the Kansas disturbances of 1856-7, and was detailed to escort the Southern Boundary Commission in 1857.

He was at Fort Leavenworth, Kansas, 1857-8, and later was engaged in the Utah Expedition and the subsequent march to California reaching as far as Fort Yuma and Fort Mojave. He returned to Benicia, California to serve until 1861.

It was during this time that Garnett attended the "Hancock party" in Los Angeles where he together with General Winfield S. Hancock and Lewis A. Armistead struggled with the difficult choice of continuing to serve under the old flag or to resign and serve their confederate states. Like many other Southerners, Garnett did not agree with secession, and he even spoke out strongly against it [the only public speech he ever gave]. However, like most all Southerners, he could not raise his hand against Virginia, and thus resigned his Commission on May 17, 1861 and offered his services to Virginia and the Confederacy.

He was commissioned a major in the corps of artillery and in November 1861 was promoted to Brigadier-General in the Confederate States army.

General Garnett was attached to the "Stonewall" Brigade, serving under General Jackson in the Valley campaigns. He was later transferred to General Pickett's division and placed in command of a brigade consisting of the 8th, 18th, 19th, 28th and 56th Virginia regiments.

At the battle of Gettysburg, although he had been very ill, he was lifted to his horse and on July 3, 1863, led his brigade, consisting of the flower of Virginia's young manhood, in the famous charge from which but a handful returned from the scene of carnage.

As he urged his men forward, Garnett shouted: "Faster men! Faster! Step out faster! Steady! Don't double quick! Save your strength and your ammunition for the final charge!" These were reputed to be his last words. General Brooke Garnett was shot from his horse while near the middle of the brigade within about 25 paces of the stone wall. [A recreation of Pickett's charge and Garnett's last moments is included in the motion picture "Gettysburg"]

Richard Garnett was never married, but did have a brief affair while on his western duty---a liaison that produced a child, William Garnett.

Richard Garnett's war effects, along with those of his cousin [General Robert Selden Garnett] are housed today in the Museum of the Confederacy. Richard's possessions, including "the Lost Sword of Richard Garnett from the battle of Gettysburg" are stored away at the Museum for research and preservation. The story of how the sword eventually got to the Museum is an interesting one. After Richard Garnett was shot from his horse in the charge at Gettysburg, his sword somehow "mysteriously" disappeared. Years later it turned up in a Baltimore pawn shop. Colonel Stuart, who had survived the charge, happened to see the piece in the pawn shop and recognising it, bought it and returned it to Garnett's niece, Mrs. John Purcell. In the middle of this current century, almost a hundred years after the battle, the sword [inscribed R. B. Garnett, U.S.A.] was donated to the Museum of the Confederacy by the Garnett family. The piece is in surprisingly good condition.

Mary married Commander John Mercer BROOKE , son of Maj.-Gen. George Mercer BROOKE and Lucy THOMAS , in 1849. John was born on 18 Dec 1826 in Tampa, Hillsborough, FL, died on 14 Dec 1906 in Lexington, Virginia, at age 79, and was buried in 1906 in Stonewall Cemetery (Presbyterian), Lexington, VA.

General Notes: 1850 United States Federal Census > Virginia > Norfolk (Independent City) > Norfolk> age 24> officer US Navy

John Mercer BROOKE was educated at Milner Hall, a preparatory school of Kenyon College, Ohio and at Burlington, New Jersey. He entered the United States Navy on March 3 1841 at the age of 15, reporting as a midshipman to Captain Farragut on the USS Delaware. In 1847 he graduated with the first class from the Naval academy at Annapolis.

He was assigned to duty at the Naval Observatory, Washington from 1851-53, and with the US Coast Survey.

While there he invented the deep-sea sounding apparatus which revolutionized communication between Europe and America, making possible the laying of the first Atlantic cable.

He was with the Naval Pacific Surveying and Exploring Expedition in the sloop of war "Vincennes" under Commodore John Rodgers, having charge of the Astonomical Department, and later was in command of a vessel making surveys of island in the Pacific and a part of the coast of Japan.

The destruction of his vessel by a typhoon in 1859 while Brooke was in Yeddo, caused him to remain in Yokohama until the following year.

In recognition of his services the Japanese offered him a purse of $60,000, which he declined. He did, however, accept their invitation to accompany them to Washington when they decided to send an embassy to the United States in 1860.

He resigned from the Navy on the succession of Virginia in April, 1861, and entered the Confederate service.

He was appointed Chief of the Bureau of Ordnance and Hydrography under the Secretary of the Navy, Stephen R. MALLORY.

While in the Navy he invented the Brooke gun, discovered the utility of the air space in cannon, designed plans for an iron-clad vessel with submerged ends, which were used in reconstruting the "Virginia" into the "Merrimac", preparatory to her memorable engagement in Hampton Roads with the Federal "Monitor", and drew up directions for the cruise of the "Shenandoah" involving the destruction of the whaling fleet.

In 1867 Brooke received from King William of Prussia the gold medal of science awarded by the Berlin Academy of Science.

In 1866 he was appointed professor of physics and astronomy at the Virginia Military Institute, Lexington, which chair he held until 1899, when he was made professor emeritus.

He died in Lexington on December 14, 1906.

He had one daughter by Miss Garnett---Anna Maria BROOKE.

He married secondly, Mrs Kate Corbin PENDLETON, widow of Lieut-Col. A.S. PENDLETON, and had two children by her.

The date of his death is unknown. National Park Service records have him mustering
out of the 38th Regiment, as a private, at the end of the war. However, Josephine Shaw
Dancy notes say he drowned at the Union prison on the Chesapeake Bay while trying to escape through a sewer. The prison was likely Point Lookout, where thousands of Confederate soldiers were imprisoned, and thousands died. There is a Stephen Shaw listed as a prisoner at that prison, but he is listed as being from a North Carolina regiment. But that regiment's records do not have a Stephen Shaw listed. It's possible his regiment was incorrect in the prison record. More research is needed. Death date and burial location unknown.
