Page 71, Jan. 1836, Court met – Monday morning Court met according to adjournment at the courthouse in the Town of Nashville where were present Allen Knight, William Williams, William James, Elihu S. Hall, Gilbert G. Washington, Daniel Buie, George W. Charlton, Francis McGavock, James Barrett, Enoch Ensley, John H. Hinton, Joseph W. Horton, Edward H. East & David Abernathy Esquires Justices.

Page 71, Jan. 1836, Names of Jurors summoned to attend the present court – The following are the names of the gentlemen appointed to attend and serve as Grand and Petit Jurors during the present court. Ewing – Received of Henry Ewing Clerk of Davidson County Court the sum of Seven thousand five hundred and sixty one dollars nineteen cents being the amount of the state tax by him collected from the first day of October A.D. 1834 up to the first day of October A.D. 1835 which by law he is agreeable to account for agreeable to his statement this day rendered to me – from said sum said Clerks commissions were deducted. Page 71, Nashville Jan. 1, 1836, A. Paynes receipt to H. Ewing - Received of Henry Ewing Clerk of Davidson County Court the sum of Nine hundred and fifty four dollars seven cents being the amount fines and amusements and County Tax on Merchants collected by him from the first day of January A.D. 1835 up to the first day of January A.D. 1836 as per statement this day rendered to me. Also the further sum of one hundred and ninety six dollars being a balance remaining in his hands of Quorum court Tax for said county over and above what has been paid to the members of said court since the first day of January 1835. Greenwood Payne County Trustee The original receipt of which the above copies were produced before the court in the presence of the Attorney General & Examined & ordered to be Entered.

Page 71, Jan. 1836, Charles Cook guardian of A. H. Owen et als - The court appoints Charles Cook guardian of Adam H. Owen, Albert G. Owen, and Edmund Owen minor orphans. Whereupon the said Charles Cook in court here gave bond in the sum of six hundred dollars with David R Owen and Isaac R Seaborn his securities for his faithful guardianship.

Page 71, Jan.. 1836, S. Alexander bound to Wm reeves - Ordered that Stephen Alexander an orphan boy of colour of the age of ten years be bound as an apprentice to William Reeves until he attains the age of twenty one years. And the said William Reeves covenants and agrees that he will teach and instruct or cause to be taught and instructed the said apprentice in the art trade and mystery of the farming business and give him such freedom dues as the law allows.

Page 72, Jan. 1836, Wm Alexander bound to Henry Kellum - Ordered that William Alexander an orphan boy of colour of the age of sixteen years be bound as an apprentice to Henry Kellum until he attains the age of twenty one years. And the said Henry Kellum covenants and agrees that he will teach and instruct or cause to be taught and instructed the said apprentice in the art trade and mystery of the farming business and give him such freedom dues as the law allows.

Page 72, Jan. 1836, R. Loftin bound to Wm Allison - Ordered that Robert Loftin an orphan boy of the age of five years be bound as an apprentice to William Allison until he attains the age of five years. And the said William Allison covenants and agrees that he will teach and instruct or cause to be taught and instructed the said apprentice in the art trade and mystery of the turning business and give him such freedom dues as the law allows.

Page 72, Jan. 1836, Thos Beavers bound to Chas Sayers - Ordered that Thomas J. Beavers an orphan boy of the age of nineteen years the 20th of June be bound as an apprentice to Charles Sears until he attains the age of twenty one years. And the said Charles Sears covenants and agrees that he will teach and instruct or cause to be taught and instructed the said apprentice in the art trade and mystery of boot and shoe making business and give him such freedom dues as the law allows.

Page 72, Jan. 1836, Wm Pope guardian of E. Brent etals – The court appoint William Pope Guardian of Eliza Brent, Joseph Brent, Albert Brent, Susan Brent, Indiana Brent and William Brent minor orphans. Whereupon the said William Brent in court here gave six several bonds in the sum of Two hundred dollars with John Pope and Samuel P Dunneway his securities for his faithful Guardianship.

Page 72, Jan. 1836, C Lanier Constable – The Court Appoint Churchill Lanier to serve as Constable in this county for the ensuing two years. Whereupon the said Churchill Lanier here in court gave bond in the sum of one thousand dollars with James Yarborough, John J Hinton, Jonathan R Garrett and Cornelius W Waggoner his securities and qualified according to law.

Page 72, Jan. 1836, Wm F White guardian of A C White & others - The court appoints William F White guardian of Arthur C White and William R. White a lunatic. Whereupon the said William F. White here in court gave bond in the sum of four thousand dollars with Charles W. Morman his security for his faithful Guardianship.

Page 72, Jan. 1836, Chas Cook guardian of P S Owen - The court appoint Charles Cook guardian of Philander L. Owen a minor orphan. Whereupon the said Charles Cook gave bond in the sum of six hundred dollars with David r Owen and Isaac R Seaborn his securities for his faithful Guardianship.

Page 72, Jan. 1836, Eliza C White adms of Wm C White – Ordered that Eliza C White have letters of Administration granted to him on the estate of William C White decd. Whereupon the said Eliza C White in court here gave bond in the sum of thirty thousand dollars with Samuel Seay, Charles W Moorman and William F White her securities and qualified according to law.

Page 72, Jan. 1836, R&G Pegram adms of B. Woodward – Ordered that Roger Pegram and George Pegram have letters of Administration granted to him on the estate of of Baker Woodward decd. Whereupon the said Roger Pegram and George Pegram in court gave bond in the sum of three thousand dollars with William Reeves and William D Hutton his securities for their faithful Administration and qualified according to law.

Page 72, Jan. 1836, Wm D Philips adm. of Tho Martin – Ordered that William D Philips have letters of Administration granted to him on the estate of Thomas Martin decd. Whereupon the said William D. Philips in court gave bond in the sum of thirty thousand dollars with Josiah F Williams and Russell Danee his securities for their faithful Administration and qualified according to law.

Page 73, Jan. 1836, E. Wright adms. of Jno B Wright – Ordered that Eveline Wright have letters of Administration granted to her on the estate of John B Wright decd. Whereupon the said Eveline Wright in court here gave bond in the sum of six hundred dollars with George W Charlton and Willoughby Williams her securities for her faithful Administration and qualified according to law.

Page 73, Jan. 1836, Saml Steele guar return - Samuel Steele guardian for Charles M. Hall, Aristine L. Hall, and Ann Eliza A. Hall minor orphans returned into court on oath an account of his said Guardianship and ordered to be recorded.

Page 73, Jan. 1836, Commissioners of poor house settlement – John C Bowers and Enoch P Connell commissioners appointed by an order of the preceding court to settle with David Ralston as Treasurer of the Poor house of this county. Now make report of having done so which is received and confirmed by the court and ordered to be recorded.

Page 73, Jan. 1836, Comrs to divide Negroes of J Dickinsons’ estate – Josiah F Williams, William Neely and William D Philips Commissioners appointed by an order of the preceding court to divide the Negroes belonging to the estate of Jacob Dickinson deceased among and between his heirs and devisees according to Law. Now make report of having done so which is received and confirmed by the court and ordered to be recorded.

Page 73, Jan. 1836, Comrs to set apart support for E. Berry – William Henry, David Mays and Alexander Allison the commissioners appointed by an order of the preceding court to lay off and set apart to Eliza Berry widow of Adam H. Berry decd. one years support for herself and her family out of said decedents estate. Now make report of having done so which is received and confirmed by the court and ordered to be recorded.

Page 73, Jan. 1836, Comrs to settle with B. Greer adms. – The court appoint John Harding, Lewin Joslin and Giles H. Page Commissioners to settle with Benjamin Greer as Surviving Administrator on the estate of James Donley decd and having done so make report thereof to our present or ensuing court.

Page 74, Jan. 1836, Com. to settle with H. Owen Exr. &c – The court appoint Enoch Ensley, Hays Blackman and Thomas S. King them or any two of them Commissioners to settle with Herbert Owen as Executor on the estate of Frederick Owen decd. And having done so make report thereof to our present or ensuing court.

Page 74, Jan. 1836, Com. to allow E C White support – The court appoint John McGavock, Claiborne Y Hooper, Joseph L Ewing, William Williams and Albert Winn them or any three of them commissioners to lay off and set apart to Eliza C White widow of William C White decd one years support for herself and family. And having done so make report thereof to our present or ensuing court.

Page 74, Jan. 1836, Com. to divide Wm. White’s estate – The court appoint John McGavock, Claiborne Y Hooper, Joseph L Ewing, William Williams and Albert Winn Commissioners to divide the real and personal estate of William C White among and between his heirs and devisees according to the Law with this reservation that the minor children of the said decdent shall not have their portions separated until they arrive at age. And having done so make report thereof to our present or ensuing court.

Page 74, Jan. 1836, Com. to settle with D B Love guar. – The court appoint William D Philips, William James, John J Hinton and Enoch Ensley Commissioners to settle with David B. Love as Guardian of the minor heirs of Jacob Dickinson decd. And having done so make report thereof to our present or ensuing court.

Page 74, Jan. 1836, Nancy Walker Will proven – A paper writing purporting to be the last will and Testament of Nancy Walker decd was produced in open court and proved thus: Robert C. Foster and Joel Watterson the subscribing witnesses to said paper being duly sworn depose and say that they became such in the presence of said decedent and at her request and in the presence of each other and that they verily believe that she was of sound mind and memory at the time of executing said paper writing. Ordered that said paper writing be admitted to record as such will of Sarah Walker decd (sic) . Whereupon Thomas S. King and Richard H. Wallace the Executors named in said will came into court and gave bond in the sum of Eight thousand dollars with Edward H East and John R Dabbs their securities for the faithful discharge of the trusts reposed in them.

Page 74, Jan. 1836, Thos S. King to sell Negroes of N. T. Walkers’ estate – On the petition and affidavit of B. R. Powell and Joseph A Bland two of the heirs and distributees of the estate of Nicholas T Walker decd representing to the court that there are seven Negro slaves belonging to the estate of said descendant to be divided among five heirs and that a division cannot be effected without a sale of said slaves. It is therefore ordered that Thomas S. King be appointed to sell said slaves on a credit of nine months at public or private sale the purchaser giving bond with approved security and having so done make report thereof to our present or ensuing court.

Page 74, Jan. 1836, Wm D Philips adm. to sell Tho. Martins’ Negroes - On the petition and affidavit of William D. Philips Administrator of the estate of the goods and chattels rights and credits of Thomas Martin decd. representing to the court that there are two Negro slaves named Julia and Penny belonging to the estate of the decedent the sale of whom would be much to the interest of the estate. It is therefore ordered that the said Administrator be authorized to sell said slaves on a credit of nine months either at public or private sale the purchaser giving bond with approved security and having done so make report thereof to our present or ensuing court.

Page 74, Jan. 1836, Sheriff to bring Jno Ivey – Ordered that the Sheriff of this county bring here into court on Monday next an orphan boy named John Ivey in order that he may be dealt with as the law directs.

Page 74, Jan. 1836, Account of sale of C. Zacherys’ Negroes – An account of the sale of the Negroes belonging to the estate of Crawford Zachery decd was returned into court by Benjamin Zachery his Administrator and ordered to be recorded.

Page 75, Jan. 1836, Coms. to settle with Wm Nichol – The Court appoint Samuel Seay, Elihu S. Hall and Alpha Kingsley them or any two of them Commissioners to settle with William Nichol as Guardian of Alexander Nichol, Jane R. Nichol, Margaret H. Nichol, Eleanor Armstrong, Josiah N. Armstrong and Josiah Nichol Jr., minor heirs. And having so done make report to our present or ensuing court.

Page 75, Jan. 1836, Wm D. Dorris Allowance – Same Court present as first named – When the court unanimously allow William D Dorris the sum of Ten dollars for medical services rendered to Peter Dozier a pauper of this county. And it is ordered that the County Trustee of this county pay him said sum out of any county money in his hands not otherwise appropriated.

And it is further ordered adjudged and decreed that Judgment be and the same is hereby entered up against the Sts money in his hands not otherwise appropriated.

Page 76, Jan. 1836, Willo. Williams allowance – Same Court Present When the court unanimously allow Willoughby Williams Esquire the sum of one hundred and sixty two dollars thirty cents for money paid by him for work done on the courthouse in this county. And it is ordered that the county Trustee of this County pay him said sum out of any county money in his hands not other wise appropriated.

Page 76, Jan. 1836, D. Judd allowance – Same Court Present When the court unanimously allow Daniel Judd Jailor &c the sum of twenty two dollars twelve and ½ cents for keeping sundry prisoners in jail. And it is ordered that the County Trustee of this county pay him said sum out of any county money in his hands not other wise appropriated.

Page 77, Jan. 1836, Donelson’s Negroes – This day Thomas H. Fletcher, Esquire presented to the court the petition of Stokley Donelson one of the Administrators of Alexander Donelson decd representing to the court that in obedience to the order of a former court he had endeavoured to procure the transportation of the Negro slaves belonging to the estate of decedent to the Colony of Liberia within the time prescribed by said order but that unavoidable delays together with the fact that each slave was compelled to give security in double the amount of his value had hitherto prevented him and praying the curt to extend the time allowed for emigration until the last of March and to require each slave only to give bond and security to the amount of his own value. which petition the court grant and order that the time be extended until the last part of March next and that bond and security be given according to the prayer of said petition.

Hays Allowance – Same Court Present When the court unanimously allow Andrew Hays Esquire Attorney General of this district the sum of fifty eight dollars sixty six and 2/3 cents for his Ex oficcio services from the First of January A.D. 1835 to the first of March A.D. 1836. And it is ordered that the County Trustee of this county pay him said sum out of any county money in his hand not otherwise appropriated.

Page 77, Jan. 1836, Willo. Willams Allowance – Same Court Present When the court unanimously allow Willoughby Williams Sheriff of this county the sum of fifty eight dollars sixty six and 2/3 cents for his Ex oficci services from the First of January A.D. 1835 to the first of March A.D. 1836. And it is ordered that the County Trustee of this county pay him said sum out of any county money in his hand not otherwise appropriated.

Page 77, Jan. 1836, Henry Ewing Allowance – Same Court Present When the court unanimously allow Henry Ewing Clerk of the court the sum of fifty eight dollars sixty six and 2/3 cents for his Ex oficci services from the First of January A.D. 1835 to the first of March A.D. 1836. Also the further sum of twenty dollars for making a list and striking the amount of Taxes for the year 1835. And it is ordered that the County Trustee of this county pay him said sum out of any county money in his hand not otherwise appropriated.

Page 77, Jan. 1836, Comrs to settle with L F Wood Adm. – The Court appoint Thomas Crutcher, Mathew Watson and Elihu S. Hall Esquires them or any two of them to settle with Larkin F Wood relative to his Administration on the estate of Thomas H. Crutcher decd and such settlement when made return into our present or ensuing court.

Page 77, Jan. 1836, Com. to divide Negroes of P Byser - The court appoint Joseph T Elliston, Anthony W. Johnson and Elihu S Hall Esquires Commissioners to divide the Negro slaves belonging to the estate of Peter Byser decd among and between his heirs according to law. And having done so make report thereof to our present or ensuing court.

Page 77, Jan. 1836, Com. to allow support to E. Wright – The court appoint john B Vanderville, Edward H East and George W. Charlton Esquires Commissioners to lay off and set apart to Eveline Wright widow of John B Wright one years support for herself and family out to said decedents estate. and having so done make report thereof to our present or ensuing court.

Page 77, Jan. 1836, Com. to divide personality of R Joslin – The court Appoint Allen Thompson, Benjamin D Pack and William Stringfellow Commissioners to divide the personal property belonging to the estate of Richard Joslin decd among and between his heirs and devisees according to law. And having done so make report thereof to our present or ensuing court.

Page 78, Jan. 1836, Com. to divide E Owens land – The court appoint Thomas Buchanan, William Murphey, John K. Buchanan, Robert Buchanan, Richard Buchanan, William Matlock and William Stewart them or any five of them Commissioners to divide the part of the land of Edmond Owen Sr decd lately occupied by his widow as dower among and between his heirs and legatees according to law and having so done make report thereof to our present or ensuing court.

Page 78, Jan. 1836, Duplicate for County Claim – For cause shown to the court it is ordered that a duplicate issue of claim No 958 on the county to William M. Cook it being for services rendered by Thomas Burgess as Juror in the Circuit Court and assigned to said Cook.

Page 78, Jan. 1836, Com. of Poor House Report – David Ralston and William James two of the Commissioner appointed to superintend the Poor house for the year 1835 Now make report of having so done and submit a statement of the number and condition of its inmates together with an account of its expenditures which is received and confirmed by the court and the Court unanimously allow each of said commissioners and also William Neely the other commissioner the sum of ten dollars. And order that the County Trustee of this county pay them said sum out of any county money in his hands not otherwise appropriated.

Page 78, Jan. 1836, Com. of Poor house – The Court appoint David Ralston, John C Bowers and William Neely Commissioners to superintend the Poorhouse for the year 1836 and that David Ralston be appointed Treasurer for said institution.

Page 78, Jan. 1836, Allowance for Trial of Negro June – Same Court Present When the Court unanimously allow Willoughby Williams Sheriff the sum of seven dollars seventy five cents. Augustus L Hays Attorney General the sum of Ten dollars. Philip Callaghan, Berryman Brown, William B. Shapard, Charles Brandon, F. To wit on each 100 acres of land, 56 ¼ cents;on each white poll, 37 ½ cents;on each slave – 75 cents; on each Town lot $1.12 ½; on each wholesale and retail store &c the sum of Ten dollars; on each stud horse or Jack kept for mares, the price of the season for one mare. Page 105, Jan. 29, 1836, Jas Owen’s Will proved - A paper writing purporting to be the last will and Testament of James Owen decd was produced in open court for probate and proved thus: Everett Owen and William Owen two of the subscribing witnesses to said paper being duly sworn depose and say that they became such in the presence of said decedent and at his request and in the presence of each other and that they verily believe that he was of sound mind and disposing memory at the time of executing said paper . Thereupon the Court appoint that the Sheriff summon a Jury of freeholders who being first duly sworn shall proceed to view mark and lay off a dower out of said land to said Sally Jordan and put her in possession of the same and having done so make report to our present or ensuing court.

To try which issue came the following Jury of good and lawful men to wit: Valentine Winfrey, Jesse D March, James W Ewen, John Morgan, James Morgan, Isaac Earthman, James Clemmons, George S Gross, Robert Bradford, Robert Lanier, Charles Abernathy and Samuel C Burton.
