
Thomas Walter Middleton Indenture

This indenture made this 7th day of October 1809 between Thomas Middleton, Charles Middleton, Greenberry Middleton, Micajah Middleton, Elijah Middleton, John Middleton, Henry H. Middleton, Thomas Middleton and Betsy his wife, and Nancy Middleton, Philip Hall and Jane his wife, John Greenwell and Sally his wife, heirs of Thomas Middleton deceased of the counties of Pulaski, Garrard, Lincoln and Bullet of the State of Kentucky of the one part and Coleman Williams and Catherine Williams infant heirs of Thomas Williams deceased of the County of Garrard and State of Kentucky of the other part.
Witness that for and in consideration of the sum of one hundred dollars paid to and received by Thomas Middleton their father in his lifetime by John Williams the father of the said Coleman and Catherine the land receipt whereof is hereby acknowledged and in performance of a deed of covenant by their father given for the conveyance of the tract of land herein described they the said Thomas, Charles, Greenberry, Micajah, Elijah, John, Henry, Thomas and Betsy, and Nancy Middleton, and Philip Hall and Jane his wife, John Greenwell and Sally his wife as heirs of the said Thomas Middleton deceased have granted bargained and sold by these presence do grant bargain and sell unto the said Coleman and Catherine Williams being aforesaid a certain tract or parcel of land lying and being in the County of Madison and State of Kentucky on the waters of Tater Creek and bounded as follows. Beginning at a sugar tree on corner of a survey made for George Boone running from thence with Boons line S25E 194 poles to his corner a linn and corner to Joseph Taylor thence with Taylor’s line the course continued 52 poles to his corner at a sugar tree thence with another line of said Taylor S37o E 24 poles to three hickories thence 36 poles to an ash corner to said Joseph Taylor’s line on the banks of Tater Creek thence up said creek with several meanders to an ash on the west bank of Tater Creek comes to the land of Zach. Davis thence with Davis line S40E 32 poles to his corner a white walnut on the bank of Sugar Camp Creek thence up the meanders thereof S20W 24 poles SSW 6 poles to another corner of said Davis’s land at an elm in the course continued up said branch to a sugar tree thence N40W 80 poles to a sugar tree thence S 65 W 180 poles to an oak thence with his line of 65E 133 poles to the beginning containing 400 acres as appears from a deed made by Green Clay to Thomas Middleton deceased to have and to hold the before mentioned tract of land with all singular its appurtenances thereunto belonging unto the said Coleman and Catherine Williams and their heirs forever and the said Thomas, Charles, Greenberry, Micajah, Elijah, Henry, John, Thomas and Betsy, Nancy Middleton, and Philip Hall and Jane his wife, John Greenwell and Sally his wife as heirs of the said Thomas Middleton deceased do warrant and forever defend the title of the before mentioned tract of land to the said Coleman and Catherine Williams against the claim of them or any of their heirs or any other person claiming unto their father Thomas Middleton or them or either of them but not to be further answerable should said land be lost than as to the heirs to the said Thomas Middleton they never having received within own behalf any consideration for the same.
