Hands for the schooner St. Patrick, at that time employed at that by the Asst Engineer of this post to carry the necessary materials for the construction of the fortifications at this post; I ordered Captain O. L. Schmawbert Commanding Co. B to make a detail of 2 sailors to report for duty aboard of the schooner St. Patrick; privates Wm Wilkenson & Frank Williams. Were detailed by him for that purpose but they positively refused to to on board the schooner St. Patrick, and Capt. Schmawbert had them confined in the guardhouse and preferred charges against them for disobedience of Orders. I transmitted the charges to Major John Ireland commanding Post of [Port] Saluria Indianola Texas on the 10th of August 1863 with the request to have said men tried by a Courtmartial. They remained in confinement to the 3rd day of October 1863, Major Jno. Ireland having not ordered a Court Martial to convene during that time, and upon my own responsibility, in accordance with General Orders from Head Quarters District of Texas, New Mexico & Arizona, giving the Commanding Officers of Posts the privilege to release such prisoners as they may see proper in their own judgment.
